Welcome to this edition of The Cincinnati Times – Labor Report. It has been an extremely active couple of months as we see the employment landscape changing.

With all this activity impacting employers, we are pleased to announce an upcoming series of seminars to start this fall in conjunction with Stephen Richey, Labor and Employment Law Partner at Thompson Hine. The first will occur in September and be focused on Wage & Hour Compliance. We need your input to make certain we are addressing the issues that are most important to you and your organization. New Online Advisor Helps Organizations Comply with ADA

NOVAtime 4000 Hosted Solution Adds New Capabilities

In February we attended the annual NOVAtime Partner Conference where we saw the latest and greatest features and modules that have been added to the 4000 SaaS solution. Among the highlights were:

  • Average Weighted Overtime – For businesses that pay their employees multiple rates during the week. This feature calculates the overtime (1/2 rate) based on the weighted average (hours x rate) paid.
  • Minimum Break Time Lockout – This feature prevents employees from returning early from a meal or a break. This is extremely useful in states where the law requires the employer to pay for short breaks or where there are rules for minors requiring a specified time off the clock based on the length of their shift.

New FLSA Requires Breaks for Breastfeeding Mothers

The health care reform bill includes an amendment to the FLSA that requires employers to provide "reasonable" break times to breastfeeding mothers. The article and criteria can be found here.

New Ruling Regarding Workplace Injuries

The Ohio Supreme Court upheld a lower Court decision that employers will not be liable for workplace injuries unless the employee can prove the employer acted with deliberate intent to harm them. Read the article from Thompson Hine here.

New Federal Law Targets "Independent" Contractors

The new law proposed April 22nd would require employers to keep records on each worker and increases the penalties on those who were misclassified as Independent Contractors. It would direct the DOL and IRS to cross refer incidents of misclassification. More information can be found here.

Use of Temporary Labor and Exposure to Lawsuits

Attorneys say temporary workers hired through staffing agencies generally are considered to be employed by both the agency and the company, even though the agency pays the salary.
